These Terms and Conditions (“Terms”) govern your access to, browsing of, and purchases made on https://researchapex.org/ (the “Site”), operated by Apex Research (“we”, “us”, “our”).

By accessing our Site, creating an account, or placing an order, you agree to be bound legally by these Terms, our Privacy Policy, our Refund, Return, and Cancellation Policy, and our Research Use Only (RUO) Policy. If you do not accept these Terms without limitation, do not access the Site or purchase any items.

1. Age Restriction & Eligibility

  • You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to purchase from this Site or submit inquiries.

  • By initiating checkout, you warrant that you are purchasing on behalf of an institutional, commercial, or academic laboratory, or that you possess the verified technical competence, protective equipment, and facilities required to handle chemical reagents safely.

2. Research Use Only (RUO) Certification

  • Strict Scientific Purpose: All items cataloged, distributed, and sold by Apex Research—including lyophilized peptides, stable solutions, coenzymes, and biochemical reference reagents—are supplied exclusively for in vitro laboratory experimentation, analytical assays, scientific calibration, and academic research.

  • Prohibition of In Vivo / Human / Animal Use: No product is intended, packaged, or approved for human consumption, clinical diagnostic procedures, therapeutic administration, cosmetics, food additives, or veterinary applications.

  • Zero Medical Guidance: We strictly do not provide instructions, protocols, or dosage advice. Any inquiry referencing human administration, personal application, or veterinary treatment will be declined immediately, resulting in the cancellation of pending orders and permanent account suspension.

  • Verification of Purity & Documentation: Reference analytical documentation (including batch HPLC and mass spectrometry characterizations confirming purity benchmarks of $\ge 99\%$) is intended solely for chemical verification, batch identification, and laboratory quality control.

3. Customer Responsibilities & Laboratory Handling

By purchasing products from Apex Research, you certify that:

  • You and your staff possess the requisite scientific training, expertise, safety equipment (including certified personal protective equipment / PPE), and laboratory facilities necessary to handle, store, and dispose of biochemical materials in compliance with OSHA standards, local environmental regulations, and recognized Good Laboratory Practices (GLP).

  • Products will be stored in designated temperature-controlled environments (e.g., lyophilized powders at $-20^\circ\text{C}$ to $-80^\circ\text{C}$; liquid solutions at $2^\circ\text{C}$ to $8^\circ\text{C}$).

  • You will not redistribute, repackage, export unlawfully, or resell any supplied chemical material to unauthorized third parties or consumer markets.

4. International Orders & Customs Compliance

  • Importer of Record: For orders delivered outside the United States, you act as the sole Importer of Record. It is your strict obligation to ensure that the ordered materials can be imported lawfully into your destination country.

  • Customs, Tariffs, & Import Duties: You are solely responsible for local customs declarations, clearance procedures, import tariffs, and applicable local taxes.

  • Customs Delays or Seizures: Apex Research makes no warranties regarding the legal importation status of chemical reagents outside the United States. In the event a shipment is refused, seized, quarantined, destroyed, or returned by foreign customs authorities due to destination-country regulatory restrictions, Apex Research cannot issue refunds or replacement shipments.

5. Orders, Pricing, and Card Payments

  • Contract Formation: Display of products on our Site constitutes an invitation to treat. Your order is an offer to purchase, which is accepted only upon order dispatch and electronic shipping confirmation. We reserve the right to decline, cancel, or limit orders at our sole discretion for safety, fraud prevention, or compliance reasons.

  • Pricing & Currency: All prices are displayed and billed in United States Dollars (USD). Prices are subject to change without prior notice, but finalized orders will reflect the price confirmed at checkout.

  • Pricing Inaccuracies: In the event of a genuine typographical or database pricing error, we reserve the right to cancel the order and issue a 100% refund.

  • Payment Processing: All payment transactions are processed through licensed, PCI-DSS Level 1 compliant payment gateways utilizing 256-bit TLS/SSL encryption. We do not store, view, or process raw credit/debit card numbers or bank credentials on our web servers.

6. Delivery & Risk of Loss

  • Dispatch: Orders are packaged in secure, neutral laboratory-grade containers and dispatched via domestic couriers (e.g., USPS, FedEx, UPS).

  • Transfer of Risk & Title: Title and risk of loss transfer to the purchaser upon physical handover of the parcel to the shipping carrier.

  • Address Accuracy & Undeliverable Parcels: If a shipment is returned to our facility due to an incomplete or incorrect shipping address provided at checkout, original shipping fees are non-refundable. Reshipment will require payment of applicable courier postage fees.

7. Returns, Refunds, and Cancellations

Due to the chemical sensitivity and thermal requirements of scientific research materials, standard consumer change-of-mind return rights do not apply to temperature-sensitive compounds:

  • Lyophilized Peptides & Liquid Reagents: Once dispatched, research compounds cannot be returned, restocked, or exchanged. We cannot verify third-party storage or environmental integrity once an item leaves our climate-controlled facility.

  • Damaged or Incorrect Items: If an item arrives broken, defective, or incorrect, you must report it within 48 hours of carrier delivery confirmation to support@researchapex.org with your order number and photographic evidence. Confirmed defective or erroneous shipments will be replaced or refunded promptly.

  • Hardware & Non-Perishable Accessories: Unopened, unused laboratory accessories may be returned within 14 days of delivery at the purchaser’s expense, subject to warehouse inspection and restocking approval.

  • Pre-Dispatch Cancellations: Orders can be canceled for a full refund at any time prior to physical fulfillment and shipping label generation.

8. Limitation of Liability

  • To the maximum extent permitted by applicable law, Apex Research shall not be liable for any indirect, special, incidental, punitive, or consequential damages, loss of research data, loss of anticipated profits, lab downtime, or regulatory penalties arising out of the handling, storage, or application of supplied materials.

  • Our maximum aggregate liability for any claim arising from or related to an order is strictly limited to the purchase price paid for the specific goods in dispute.

9. Intellectual Property

All proprietary content on this Site—including logos, product descriptions, website layouts, custom graphics, and downloadable analytical specifications—is the intellectual property of Apex Research and protected under US and international copyright and trademark laws.
